These Terms and Conditions of Use ("Terms") constitute a binding legal agreement between Potafo Technologies Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at NO.24/1598/B6, 1st Floor, KPM Arcade, Thondayad Bypass, Chevarambalam, Kozhikode, Kerala, 673017 (hereinafter, "Potafo", "we", "us", or "our"), and any natural or legal person accessing, using, or registering on the Potafo mobile application, website, or any other platform operated by Potafo (the "Platform") for availing services (the "User" or "you").

• "Company" / "We" / "Us" means Potafo and its affiliates, successors, officers, employees, and service providers.
• "User" / "You" means any person who accesses, registers with, or uses the Platform.
• "Merchant" means any third-party seller (restaurants, grocery stores, etc.) listing products on the Platform.
• "Delivery Partner" means third-party personnel facilitating pickup and delivery.
• "Products" means items offered by Merchants through the Platform.
• "Order" means a confirmed purchase request placed by a User through the Platform.
• "Services" means ordering, payment facilitation, and delivery logistics offered via the Platform.

The Platform is a technology intermediary connecting Users, Merchants, and Delivery Partners. Potafo does not manufacture, own, or sell Products; responsibility for quality, safety, and compliance rests with the Merchant.

You must be 18+ and legally competent. Certain features require registration with accurate, current details. You are responsible for safeguarding credentials and all activity under your account.

Orders constitute offers to Merchants and are subject to acceptance and availability. Prices are set by Merchants; additional delivery/platform charges and applicable taxes may apply. Payments can be via UPI, cards, net banking, wallets, or cash on delivery (where enabled).

Orders may be cancelled before Merchant acceptance. Refunds (where applicable) are processed back to the original payment method per the Refund & Cancellation policy timelines.

Use the Platform lawfully. Do not interfere with operations, misuse services, or harass Delivery Partners or staff.

All Platform IP (software, design, trademarks, content) belongs to Potafo or licensors. You receive a limited, revocable license to use the Platform for personal, non-commercial ordering.

Data is collected and used per the Privacy Policy for account management, order processing, customer support, security, and legal compliance.

To the extent permitted by law, Potafo is not liable for indirect or consequential damages. You agree to indemnify Potafo against claims arising from your use or breach of these Terms.

These Terms are governed by Indian law and subject to courts at Kozhikode, Kerala.
